Public offer of a voluntary charitable donation
This offer is addressed to an indefinite number of persons – individuals and legal entities – visitors to the website on the Internet: https://helpful.com.ua (hereinafter referred to as the Site), hereinafter referred to as the “Benefactor”, and is an official and public offer of the Charitable Organisation “Korysni”, hereinafter referred to as the “Foundation”, represented by the founder Koval Artem Yurievich, acting on the basis of the Charter, to conclude a charitable voluntary donation agreement (hereinafter referred to as the Agreement), the subject and essential terms of which are specified below:

1. Terms and definitions:
Acceptance – full and unconditional acceptance of a public offer by making a money transfer using payment forms and means posted on the website, social networks or other open sources, as well as by transferring funds to the current account of the Foundation through bank institutions. The moment of acceptance is the date of crediting the funds to the current account of the Foundation.Payment is a voluntary charitable donation.Voluntary charitable donation is a money transfer made by the Donor to achieve the goals, objectives, directions and types of statutory activities of the Foundation in accordance with the Agreement and the Law of Ukraine “On Charitable Activities and Charitable Organisations”.

2. Subject of the Agreement:
The subject matter of this Agreement is the donation of funds by the Donor to the Foundation to achieve the goals, objectives, directions and types of statutory activities of the Foundation. The acceptance of the Agreement means that the Donor agrees with all its provisions, is fully aware of the subject matter of the Agreement and the purpose of the donation. The Agreement is concluded by the Donor’s unconditional and full accession to this Agreement and acceptance of all essential terms of the Agreement.The Donor and the Foundation, the Manager Art. 207, Part 2 Art. 639, Art. 641, 642 of the Civil Code of Ukraine, Art. 7 of the Law of Ukraine “On Charitable Activities and Charitable Organisations”, agree that the Agreement shall be deemed to be concluded in writing without the Parties signing a written copy from the moment the Donor performs the actions stipulated by the Agreement, which indicate the consent to comply with the terms of the Agreement.The Agreement is posted on the website https://helpful.com.ua (in free access and in a manner that ensures that every person applying to the Foundation is familiar with the content of this Agreement.
The Benefactor may NOT offer its own terms of the Agreement.

3. Rights and obligations of the parties:
The Foundation has the right to:- Receive voluntary charitable donations and use them to achieve the goals, objectives, directions and types of statutory activities of the Foundation in accordance with the Agreement and the Law of Ukraine “On Charitable Activities and Charitable Organisations”. – At the request of the Donor, provide a report on the voluntary charitable donation received and its use.The Donor has the right to: – Transfer the voluntary charitable donation to the account of the Foundation in the manner specified in the Agreement; – Request a report on the use of the voluntary charitable donation.

4. Place of fundraising:
Voluntary charitable donations may be collected in any country in the world.

5. Fundraising period:
The collection of voluntary charitable donations continues until the Foundation is liquidated, unless another term is determined by the Foundation.

6. Procedure for General Access to the Foundation’s Reports:
Access to the Foundation’s reports is provided by posting them on the website in the “Reports” section. Other information may be provided by the Fund in accordance with the procedure and within the timeframe provided for by the legislation of Ukraine.

7. All expenses for payment of amounts related to the Transfer of the Donation shall be borne by the Donor.

8. Other conditions
The Donor independently determines the amount of the voluntary charitable donation. The donation is voluntary and non-refundable.
The Donor agrees to redistribute and use his/her voluntary charitable donation in other projects of the Foundation if the fundraising for the current project is collected in full or in case of its failure to be implemented within the specified period.
The donor is responsible for the accuracy of the information provided when transferring the donation.
In order to comply with the Law of Ukraine “On Personal Data Protection” and to fulfil the terms of the Agreement, the Donor agrees to the processing of personal data.
The provisions of Ukrainian legislation shall apply to the relationship between the Donor and the Foundation.
